1. General Provisions
1.1. This Service Agreement (hereinafter – “Agreement”) is a public offer made by Forestik (hereinafter – “Contractor”), published on the website, to any individual or legal entity (hereinafter – “Client”) who wishes to receive construction, renovation, or related consulting services (hereinafter – “Services”).
1.2. This Agreement is considered a public offer in accordance with applicable law and shall be deemed fully and unconditionally accepted by the Client from the moment of any of the following actions:
Submitting a request, application, or contact form on the website;
Making payment for the Contractor’s services;
Beginning to use the Contractor’s services in any form.
1.3. By accepting this Agreement, the Client confirms that they have read, understood, and agreed to all its terms and conditions without exception.
2. Subject of the Agreement
2.1. The Contractor provides the Client with construction-related services, consulting, design assistance, renovation, or other related works as described on the website or as agreed upon individually via electronic communication.
2.2. The type, scope, and timeline of services shall be determined based on the Client’s request and confirmed by written communication (including email).
2.3. The Contractor provides services remotely or on-site, depending on the nature of the project and agreed terms.
3. Procedure for Service Provision
3.1. The Client submits a service request via the website or email. After receiving the request, the Contractor contacts the Client to clarify project details, deadlines, and cost.
3.2. Services are rendered upon mutual agreement of the parties, which may include signing a digital or physical project confirmation.
3.3. Communication between the parties may occur via email, phone, or other electronic means.
3.4. The Contractor has the right to involve third parties in the performance of services without additional consent from the Client, provided that this does not affect the quality of service.
4. Service Cost and Payment Procedure
4.1. The cost of services shall be determined individually for each Client based on the nature, complexity, and volume of work.
4.2. Prices listed on the website are indicative and may vary depending on the Client’s specific requirements.
4.3. Payment is made via the methods specified on the website or agreed upon in correspondence (bank transfer, online payment, or other forms).
4.4. The Client is considered to have fulfilled the payment obligation upon the funds being credited to the Contractor’s account.
4.5. In case of late payment, the Contractor reserves the right to suspend or terminate service provision until full payment is received.
5. Rights and Obligations of the Parties
The Contractor undertakes to:
Provide services in a timely and professional manner, in accordance with this Agreement;
Inform the Client about significant circumstances affecting service delivery;
Maintain confidentiality of all information received from the Client.
The Client undertakes to:
Provide accurate and complete information required for service provision;
Pay for the services within the agreed time frame;
Not use the Contractor’s materials or information in violation of intellectual property rights.
The Contractor has the right to:
Refuse service provision if the Client provides incomplete or false information;
Modify website content, service terms, or pricing at any time without prior notice (changes take effect upon publication).
The Client has the right to:
Receive quality services within the scope and timeframe agreed upon;
Request clarification or progress updates during service performance.
6. Liability of the Parties
6.1. Each Party shall be liable for failure to perform or improper performance of its obligations under this Agreement in accordance with applicable law.
6.2. The Contractor shall not be liable for:
Delays or failures caused by the Client’s fault or untimely provision of necessary information;
Indirect, incidental, or consequential losses incurred by the Client;
Unforeseen technical malfunctions or interruptions of third-party services (hosting, payment systems, etc.).
6.3. The total liability of the Contractor under this Agreement shall not exceed the total amount paid by the Client for the respective service.
7. Dispute Resolution
7.1. All disputes, disagreements, or claims arising from this Agreement shall be resolved through negotiations and mutual consultation.
7.2. If the dispute cannot be settled amicably, it shall be referred to the competent court in accordance with applicable law.
8. Confidentiality and Personal Data Protection
8.1. The Contractor undertakes to ensure the confidentiality of all information received from the Client in the course of cooperation.
8.2. The Client consents to the processing of their personal data by the Contractor for purposes related to service delivery, marketing, and communication, in accordance with the Privacy Policy published on the website.
8.3. The Contractor shall not disclose or transfer personal data to third parties except as required by law.
8.4. The Client may at any time request access, correction, or deletion of their personal data by contacting the Contractor via.
9. Other Conditions
9.1. This Agreement constitutes a legally binding public offer and does not require a handwritten signature.
9.2. The Contractor reserves the right to amend this Agreement at any time. Updated versions will be published on the website and take effect immediately upon publication.
9.3. The invalidity of any clause of this Agreement does not affect the validity of its remaining provisions.
9.4. All communications and notices under this Agreement shall be deemed valid if sent via email or through the website’s contact form.
